An Action to Annul an Arbitral Award as a Mechanism for Judicial Oversight: An Analytical Study within the Saudi Legal System

Abstract

This study investigates the legal framework governing judicial review of arbitral awards through annulment actions under the Saudi Arbitration Law, focusing on the legal nature, characteristics, procedures, and consequences of annulment proceedings. Using an analytical approach to statutory texts, the study examines the concept of judicial review of arbitral awards, the nature and procedures of annulment actions, the grounds upon which such review may be exercised, and the effects resulting from a judgment of annulment. The findings reveal that judicial review is confined to verifying the validity of the final arbitral award within the exclusive grounds prescribed by law, thereby ensuring compliance with public policy. The study further concludes that an annulment action is an independent legal remedy of a special nature rather than a conventional form of appeal. Moreover, interlocutory or preliminary decisions issued during arbitration proceedings cannot be challenged separately; instead, objections concerning such decisions may only be raised within an action seeking the annulment of the final award that conclusively resolves the dispute.
