The Legal Foundation of Innovative Waqf and Its Applications in the United Arab Emirates

This study examines the concept of innovative waqf, a contemporary form of endowment designed to integrate charitable endowments into the daily lives of individuals and institutions. Departing from traditional models often limited to real estate, it focuses on expanding endowment opportunities to all societal segments—regardless of financial capacity—through novel instruments aligned with modern socioeconomic realities. The study explores applications of these models in the UAE, particularly through Dubai’s "Innovative Waqf Journey" initiative. Three primary methodologies—the inductive method (to derive waqf principles from primary sources), the analytical method (to examine concepts and evolutions of innovative waqf, and the comparative method (to contrast traditional vs. contemporary waqf and differing juristic/legal frameworks) were employed. The study key findings indicate that innovative waqf serves as an effective instrument for socioeconomic and community development, transitioning from static endowment concepts to dynamic, interactive models. The study establishes the juristic and legal validity of usufructuary waqf) and temporary waqf, opening expansive avenues for endowment innovation. Innovative waqf enhances sustainability in charitable work and broadens participation through accessible, efficient mechanisms.
