Divorce via Social Media: A Jurisprudential Study

This study explores the phenomenon of divorce via social media, seeking to clarify its concept, the meaning of social media in this context, methods of analyzing divorce images presented online, and the Islamic legal rulings related to divorces conducted through such platforms. Employing both descriptive analytical and deductive approaches, the research is structured into an introduction, two main sections, and conclusions: the first examines the nature of divorce through social media, while the second investigates its legal rulings. The findings suggest that divorce by written messages on social media is valid, as clear writing with intent can substitute for speech and be preserved as evidence. Similarly, divorce through voice messages is unanimously recognized by scholars, provided the speech is clear and attributable to the marriage. Moreover, divorce conducted via live video applications is considered more reliable than writing or voice alone, as it brings both parties together in real time despite physical distance. Based on these results, the study recommends that Islamic countries update family laws to account for contemporary developments and regulate family provisions accordingly.Downloads
