Abstract

This research aims at studying the impact of a wife's work on the alimony. This is because the issue of alimony is one of the most controversial issues between the spouses. It is one of the most topics that revolve in the corridors of the Islamic courts and lead and perhaps increased the dispute between spouses. When a wife goes out for working and earing, some husbands find that it is their right to get some of a wife' earns. However, some say whatever she earns is of her own right so that a husband has no right to take part of it. Some husbands suggest that if a wife works and earns so a husband is not obliged to give her any alimony. Some husbands see that a husband is not obliged to spend on her as long as she has a job to earn from it. In her turn, a wife sees that whatever she earns is of her own and a husband has no right to share her earnings and it is their rights to get alimony from a husband even if they are working. It is because of this controversial issue, the researcher wanted to discuss this it to know how affected the expense of the wife's work if she was working? Does a husband have the right to be paid by the wife from work? If it has a right, is it absolute or restricted? The research is divided into an introduction, four sections, and a conclusion as follows: The first section deals with the concept of marital alimony, and its rule. It is divided into two subsections; - The first subsection concerns with the definition of alimony in language and convention. - The second subsection discusses the rule of alimony, and evidence of legitimacy. The second section discusses the conditions of the requisites of marital alimony, the reasons and its needs. It includes three subsections: - The first subsection explores the conditions for marital alimony. - The second subsection presents the causes of alimony. - The third subsection presents the requisites of alimony. The third section is devoted to the legality of a wife's work and its impact on alimony. It includes three subsections: - The first subsection discusses the legislation of a wife's work. - The second subsection tries to make an end to the dispute and the scholars' says in this regard. - The third subsection shows the evidence, discussion and advantages.
