Morphological Rules and Their Role in Understanding the Jurisprudential Text: An Applied Study in Al-Sharqawi’s Hashiyah

Abstract

This research investigates the role of morphological rules in deepening the understanding of jurisprudential texts through an applied analytical study of Imam Al-Sharqawi’s Hashiyah ‘marginal commentary’ on Tuhfat al-Ṭullab. Using a descriptive-analytical and comparative approach, the study explores how morphological structures generate meaning and influence legal interpretation. The findings indicate that verb forms and derivational patterns carry functional significance beyond grammar: the past tense affirms realization and obligation, the present tense implies continuity, and imperative and prohibitive forms express binding demands unless modified by context. The infinitive conveys generality, and forms of exaggeration emphasize constancy and intensity. Differences between transitivity and voice further determine legal responsibility and agency. Al-Sharqawi’s commentary reveals a keen morphological awareness that ties legal rulings closely to linguistic form, refining juristic preference and minimizing interpretative conflict. The study concludes by recommending the integration of morphological analysis into jurisprudence and principles curricula, the creation of a morphological-legal lexicon, and further comparative applications on classical jurisprudential commentaries.
