The Jurisprudence of Priorities in Maintenance when Rights Conflict: A Fundamental and Applied Study

This study seeks to formulate a jurisprudence of priorities in cases of conflicting rights to maintenance, by clarifying its legitimacy, requirements, and the principles governing the prioritization of those entitled to it in accordance with Islamic law’s objectives of justice. Employing an inductive-analytical method, the researcher examined religious texts and juristic opinions, then analysed them to derive practical rules and guidelines. The work is structured into an introduction, a preface, and two chapters: the preface defines essential terms; the first chapter explores maintenance obligations arising from marriage, kinship, and ownership; while the second chapter addresses criteria for prioritization in cases of conflict. The findings affirm that maintenance is a fundamental right essential for preserving life, that prioritization ensures fairness when resources are limited, that rights are ordered by necessity before needs and enhancements, and that both the objectives of Sharia and degrees of kinship must be considered in determining entitlement.
