الملخص

يهدف البحث إلى دراسة دور نظام التحكيم في حل منازعات الاستثمار الأجنبي، إذ يعتبر التحكيم التجاري الدولي وسيلة لتسوية النزاعات التجارية الدولية القائمة ووسيلة مهمة لتجنب ظهور أي نزاعات على المدى الطويل؛ فضلًا عن ذلك فإن أسلوب التحكيم لتسوية النزاع له خصائصه الخاصة التي يتميز بها، من خلال قيامه: بتسوية النزاع بحكم قطعي، ويتميز بطابع تعاقدي بين المحكم والطرف الذي اختاره بشكل مباشر، أو بشكل غير مباشر، عن طريق إحدى الهيئات. والمحكم الدائم الذي تم اختياره بناء على ذلك الاتفاق لا يخضع للطرف الذي اختاره، وهو مستقل ومحايد في أداء مهمته، فلا يتلقى تعليمات أو توجيهات من الطرف الذي اختاره. اهتم المنظم السعودي بتنظيم أحكام وضوابط التحكيم بشكل عام، والتحكيم التجاري الدولي على وجه الخصوص، وذلك من خلال إصدار نظام التحكيم، وما تبعه من إصدار اللائحة التنفيذية، والقرارات المنظمة لعملية التحكيم، والتوسع في إنشاء مراكز التحكيم الدولية؛ مثل المركز السعودي للتحكيم التجاري الدولي؛ وكان لكل ذلك الأثر الكبير في تشجيع الاستثمارات الأجنبية المباشرة، مما ساعد على حل المنازعات الناجمة عن هذه الاستثمارات بشكل سريع ومهني؛ لقد تناولت ذلك في هذا البحث من خلال ثلاثة مباحث رئيسية؛ تناولت في المبحث الأول مفهومي التحكيم والاستثمار الأجنبي المباشر؛ وفي المبحث الثاني تناولنا شرح اتفاق التحكيم وخصائصه وإقرار اتفاقات التحكيم؛ وفي المبحث الثالث والأخير تناولنا جانبًا أكثر تحديدًا للتحكيم التجاري الدولي في المملكة العربية السعودية.
