International Criminal Justice in Public International Law: A Comparative Study

This research undertakes a comparative study of international criminal justice within the framework of international public law, examining it as a form of positive justice shaped by human legislation and implemented through the executive, legislative, and judicial branches. In response to the global descent into chaos, crime, and human rights violations—fueled by tyranny and political self-interest—humanity has turned back toward justice with humility and remorse. The study explores the concept of justice as rooted in the collective conscience of the oppressed, engaging with relevant legal literature to propose corrective conceptual frameworks. Structured across several thematic axes, the research defines criminal justice and its components, analyzes the principle of legitimacy in both Roman-Germanic and Anglo-Saxon legal traditions, and investigates how these elements influence the understanding of international criminal justice. It concludes by presenting a consensus definition among legal scholars, outlining the foundational principles of justice, and critically assessing the influence of global powers in distorting its intended course.
